Final Overs (VR Cricket) Privacy Policy

Section 1. Introduction

1.1 Your use of any user data collected or processed through the Meta Horizon platform, directly or indirectly, is subject to this Developer Data Use Policy (“Policy”).
1.2 This Policy explains your obligations regarding the receipt, collection, use, and processing of User Data (defined below) in connection with Final Overs (VR Cricket) distributed via the Meta Horizon platform.
1.3 This Policy, along with other applicable Meta terms and policies available to you (including those on the Meta Quest Developer Dashboard), governs your use of the Meta Horizon platform, data retrieval, and data provision to Meta.
1.4 This Policy is effective upon your acceptance or first access/use of the Meta Horizon platform and continues until you cease using the platform, unless terminated earlier as described.
1.5 Non-compliance with this Policy or other applicable terms and policies may result in suspension or removal of your Content and limited or terminated developer access to the Meta Horizon platform.
1.6 Capitalized terms not defined in this Policy (including Section 11 “Glossary”) have the meanings given in other Meta terms and policies, including the Terms of Service. “Including” means “including without limitation.”

Section 2. Data You Collect From End Users

2.1 You are responsible for obtaining necessary permissions/consents from end users and/or relying on an appropriate legal basis for processing Developer User Data, as required by law. You must obtain consent or clear direction from end users before providing any Developer User Data to Meta.
2.2 You must clearly articulate your collection, use, and processing of Developer User Data and User Data in a publicly accessible privacy policy and adhere to it. You are responsible for complying with all privacy and data protection laws in all applicable jurisdictions.
2.3 Your privacy policy cannot supersede, modify, be less protective than, or contradict this Policy or other Meta terms and policies regarding User Data. This Policy applies to all User Data regardless of your privacy policy disclosures. For example, selling User Data is prohibited, even if disclosed in your privacy policy.
2.4 You must maintain a publicly available privacy policy with current links in your Content submission documentation, accessible to end users on the product description page, while using the Meta Horizon platform.

Section 3. Permitted Uses of User Data

3.1 You may use User Data solely for:
(a) Running, supporting, and maintaining Final Overs (VR Cricket) to provide or improve the end user experience.
(b) Conducting aggregated, de-identified, or anonymized analytics on your Content to improve it, without identifying individual users or devices.
3.2 You may use Meta Horizon User Data (excluding Device User Data) solely for:
(a) Providing users with information about, or the opportunity to obtain, new or existing features/functionality in Final Overs (VR Cricket) or other applications offered by your legal entity or Affiliate.

Section 4. Prohibited Uses of User Data

You will not engage in, or support others in engaging in, any Prohibited Practices:

4.1 Retaining, using, or disclosing User Data for purposes other than those in this Policy, the SDK License Agreement, and other applicable agreements with Meta.
4.2 Using User Data for marketing/advertising beyond Section 3’s explicit permissions.
4.3 Selling, licensing, or sharing User Data for commercial purposes.
4.4 Using User Data for discriminatory profiling based on protected characteristics (race, ethnicity, etc.).
4.5 Using User Data for surveillance purposes (except responding to valid court orders with written notice and evidence to Meta, unless prohibited by law).
4.6 Using User Data to identify a natural person beyond what’s disclosed in the User Data (e.g., through AI, facial recognition).
4.7 Combining User Data with other data, except as permitted in Section 3.
4.8 Attempting to decode, reverse engineer, or re-identify anonymized User Data.
4.9 Using User Data in any way that infringes on rights or violates laws/regulations.
4.10 Using automated means (bots, scrapers, etc.) to collect User Data.
4.11 Sending Device User Data (excluding Meta Horizon User Data) to Meta through business tools/products (e.g., Ads or Analytics).

Section 5. Sharing User Data

You may share User Data only:

5.1 With explicit end user direction or consent (proof must be retained and provided to Meta upon request).
5.2 With Service Providers and their sub-Service Providers, under written agreement ensuring their compliance with this Policy and limiting use to providing services to your app, with your responsibility for their actions. You must provide Meta with a list of Service Providers and sub-Service Providers upon request.
5.3 When required by applicable law/regulation (proof must be retained and provided to Meta upon request).

Section 6. Security & Deletion

6.1 Data Security Requirements: You must maintain industry-standard, legally compliant safeguards to prevent unauthorized processing of User Data.
6.2 Data Deletion: You must delete User Data promptly when requested by a user, upon account deletion, when no longer necessary, when requested by Meta, or as required by law.
6.3 Incident Notification: Notify Meta immediately of any unauthorized data processing or security incidents using the Incident Reporting Form.

Section 7. Compliance Review Rights

7.1 Content Review: Content using data-sharing APIs or accessing Meta Horizon User Data requires review and compliance with this Policy for Data Sharing approval.
7.2 Regular Monitoring: Meta may review your Content’s compliance, including regular monitoring of data access and processing.
7.3 Certification: Annual self-certification of compliance with this Policy is required for continued Data Sharing.
7.4 Audit: Meta may audit your and your Service Providers’ IT Systems and Records for compliance under Necessary Conditions.

Section 8. Enforcement

8.1 Meta may enforce this Policy and/or suspend your Content for suspected violations.
8.2 Enforcement actions may include Content removal, suspension of Data Sharing, platform access removal, data deletion requirements, or agreement termination.
8.3 Circumventing enforcement actions may result in permanent Content and account removal.

Section 9. General

9.1 Transferring rights/obligations under this Policy requires Meta’s prior consent.
9.2 Compliance with all applicable laws and regulations is mandatory. More restrictive terms prevail in case of conflicts.
9.3 Meta may amend this Policy. Continued platform use constitutes agreement to amendments.
9.4 Meta may change, suspend, or discontinue the Meta Horizon platform.
9.5 Upon termination, granted rights cease, and User Data use stops, but certain sections remain in effect.

(Applies to processing of Meta Ireland Data transferred outside the EEA.)
